Assault
Intentionally, knowingly, or recklessly causing harm or bodily injury to another; or causing contact with another person and should reasonably know that the other will regard such contact as offensive or provocative.
Resisting Arrest, Search, or Detention
The prevention or obstruction of a law enforcement officer from arresting, searching, or detaining an individual.
ENHANCEMENT Offense Level is upgraded to Third Degree Felony if a firearm or other deadly weapon is used to resist.
Evading Arrest or Detention
Fleeing, or attempting to flee, a law enforcement officer who is attempting to arrest or detain them.
ENHANCEMENT Offense Level is upgraded to Third Degree Felony if: 1. A vehicle or watercraft (bicycles are court decision) is used to evade arrest or detainment; and/or 2. Causes bodily injury.
Unlawful Restraint
Restricting the movement, as to substantially interfere with the liberty, of an unwilling person.
ENHANCEMENT Offense Level is upgraded to Third Degree Felony if the restrained person is a public servant or law enforcement officer while discharging their duty in an official capacity.
Abuse of Official Capacity
Misuse of government property, personnel, or services by a member of law enforcement, or any other member of public or government office with intent to defraud or harm another for personal or professional gain.
Tampering with a Government Vehicle
Intentionally tampering, operating, or entering a government or law enforcement vehicle, including but not limited to operating, activating, or deactivating any operational vehicle component
Burglary of Vehicle
Entry into a vehicle of any type without express consent of the owner with the intent to commit theft.
ENHANCEMENT Offense Level is upgraded to Third Degree Felony if the vehicle is owned by the government or emergency services.
Money Laundering
Concealing or disguising original control and or ownership of illicit proceeds generated through criminal or illegitimate means.
Value of proceeds is $1,000 or more but less than $5,000.
Criminal Mischief
Damage or destruction resulting in loss.
Loss valued at $1,000 or more but less than $5,000.
Possession, Manufacture, Sale, or Delivery of Marijuana
Illegally possessing, or facilitating the production or creation of Marijuana by planting, cultivation, or other means.
50 or more units but less than 100 units. *Sale of any amount of Marijuana IS illegal unless licensed*
Possession, Manufacture, Sale, or Delivery of Controlled Substance:
Illegally possessing, or facilitating the production or creation of Schedule I narcotics by planting, cultivation, or other means.
1 or more units but less than 6 units.
Hit and Run
Failure to stop and remain at the scene of an accident involving damages, or injury.
Damages valued more than $300. OR Injuries are sustained as a result of the hit and run.
Impersonating a Military Service Member, Veteran, or Public Official
Whoever falsely impersonates an active or reserve component military service member, veteran, or public official.
ENHANCEMENT Offense Level is upgraded to Second Degree Felony if a firearm or destructive device is displayed during the commission of the crime.
Criminal Trespass
Entering or remaining at a location or property without the express consent of the lawful owner or primary occupant.
ENHANCEMENT The Offense level is upgraded to Class A Misdemeanor if the property is owned by the government.
Failure to Identify
Refusing to provide truthful identification or personal information upon request by law enforcement.
Harassment
The intentional embarrassment, harassment, annoyance, or abuse of a person(s), made via comment, suggestion, request, or other means of verbal or written means, when the person(s) have clearly communicated the effects of such.
Driving Under the Influence / Driving While Intoxicated
Operating any motor vehicle, aircraft, or watercraft while intoxicated or under the influence of alcohol, controlled substance, or any other substance that impairs the ability to operate a motor vehicle, aircraft or watercraft in a safe and responsible manner. The legal BAC limit for alcohol is 0.08.
ENHANCEMENT Offense Level is upgraded under the following conditions: 1. Class A Misdemeanor – Second offense; 2. Third Degree Felony – Third offense; 3. Second Degree Felony – Fourth and subsequent offense(s); 4. Second Degree Felony – Any injury is sustained; 5. First Degree Felony – Any death is caused.
Obstructing Road or Other Passageway
Obstructing a public roadway, street, garage, runway, or other mediums of travel, without legal authority, with the intent to prevent, obstruct, or hinder movement.
Reckless Operation of a Vehicle
Operating a vehicle, aircraft, vessel, or watercraft with willful or intentional disregard for the safety of others or property.
Racing
Racing another vehicle, aircraft, or watercraft on a public road, highway, airspace, or water unless it is a sanctioned event.
ENHANCEMENT Offense Level is upgraded one level to Class A Misdemeanor if previously convicted of offense.
Repeat Moving or Traffic Violation Offender
Operating a motor vehicle in a reckless or irresponsible manner and not adhering to traffic control devices or traffic laws and have a minimum of five prior moving violations.
ENHANCEMENT Offense Level is upgraded with the following provisions: 1. Class A Misdemeanor: 10 or more but less than 20 moving violations; 2. Third Degree Felony: 20 or more but less than 30 moving violations; or 3. Second Degree Felony: 30 or more moving violations.
Failure to Comply with an Officer
Any person who willfully fails or refuses to comply with any lawful order or direction of any peace officer invested by law with autority to direct, control, or regulate traffic.
Obstructing Legal Process, Arrest, or Firefighting
Any person who willfully obstructs, hinders, or prevents the lawful execution of any legal process, civil or criminal, or apprehension of another on a charge or conviction of a criminal offense; obstructs, resists, or interfes with a peace officer while the officer is engaged in the performance of offical duties; interferes with or obstructs a firefighter while the firefighter is engaged in the performance of offical duties; interferes with or obstructs a member of an ambulance service personnel crew who is providing or attempting to provide ermegency care.
ENHANCEMENT Offense Level is upgraded to a Class A Misdemeanor if the act was accompanied by force or violence or the threat thereof. Offense Level is upgraded to Third Degree Felony if the person knew or had reason to know that the act created a risk of death, substantial bodily harm, or serious property damage. Offense Level is upgraded to Second Degree Felony if the act caused death, substantial bodily harm, or serious property damage
Exhibition Driving
Any person who drives any vehicle upon a highway, alley, public park, recreational area, or upon public property in such a manner that creates or causes unnecessary engine noise, skid, or slide upon acceleration or stopping; that simulates a temporary race; or that causes the vehicle to unnecessarily turn abruptly or sway.
Driving an invalid registration of a vehicle.
